GAIYA, LLC is the operator of the website located at www.shopgaiya.com (the “Website”). This Agreement governs your use of the Website and your purchase of any products from GAIYA (the “Products”).
THIS AGREEMENT CONTAINS AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT WAIVE YOUR RIGHT TO A COURT HEARING OR JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW OR IF YOU OPT-OUT. YOU MUST REVIEW THIS DOCUMENT IN ITS ENTIRETY BEFORE ACCESSING, USING, OR BUYING ANY PRODUCT THROUGH THE WEBSITE.
GAIYA is currently collecting sales tax only in the state of Florida due to having a "significant presence" in the state of Florida. Florida customers that process to checkout and confirm shipping details, applicable taxes will be calculated on your total merchandise value. Additionally, order totals at checkout reflect estimated tax. The actual charge to your payment method will reflect all applicable state, local and county taxes and will be calculated once your order is shipped.
Florida Sales Tax
Each sale, admission, storage, or rental in Florida is taxable, unless the transaction is exempt. Sales tax is added to the price of taxable goods or services and collected from the purchaser at the time of sale. Florida's general state sales tax rate is 6% with the following exceptions: 4% on amusement machine receipts, 5.5% on the lease or license of commercial real property, and 6.95% on electricity.
Due to GAIYA, LLC collecting sales tax only in the state of Florida, customers from all other states needs to record and pay sales tax according to their states policy. By purchasing from GAIYA, customers agree to keep full records and pay their state tax accordingly. Customers accept full responsibility to report sales tax to their respective states.
Notice and report states
Notice and report tax laws exist in some states to ensure that customers pay a use tax. GAIYA does not have nexus (significant presence) in the states listed below but sell to customers there. Customers are responsible for paying a use tax to the state, rather than paying sales tax to GAIYA.
